Terms of Use

Article 1: Purpose

These Terms of Use (“TOU”) govern the legal framework for the use of the services provided on the website berclet.fr (hereinafter referred to as “the Site”). They constitute a contract between CG Conception and the User. Access to the Site requires acceptance of these TOU. By accessing this platform, the User confirms their full acceptance of the present Terms.

Article 2: Legal Notice

The website berclet.fr is published by CG-Conception, registered with the RCS of Tours under SIRET number 834 602 591 00036, with its registered office located at 1 Chem. des Brèches, 37510 Saint-Genouph, France. The website is hosted by OVH.

Article 3: Access to the Site

The website berclet.fr provides free access to the following services:

  • 1 – Home
  • 2 – How does it works
  • 3 – Team
  • 4 – Contact.
  • 5 – Shop.

The Site is accessible free of charge from anywhere by any user with an Internet connection. All costs related to access (computer equipment, Internet connection, etc.) are the User’s responsibility. Access to the services does not require a username or password. For maintenance or any other reason, access to the Site may be interrupted or suspended by the publisher without prior notice or justification.

Article 4: Data Collection

In accordance with French Law No. 78-17 of January 6 on Information Technology, Files, and Civil Liberties, the collection and processing of personal data respect the User’s privacy. Under Articles 39 and 40 of this law, the User has the right to access, rectify, delete, and oppose their personal data. This right can be exercised via the contact form available on the Site.

Article 5: Intellectual Property

All trademarks, logos, and content on berclet.fr (graphic illustrations, text, etc.) are protected by the French Intellectual Property Code and copyright laws. Any reproduction or copying of content by the User requires prior written authorization from the Site. Use of the content for commercial or advertising purposes is strictly prohibited.

Article 6: Liability

Although the information published on the Site is considered reliable, the Site does not guarantee the accuracy of the sources. The information provided is for informational purposes only and has no contractual value. Despite regular updates, the Site cannot be held responsible for administrative or legal changes occurring after publication. The same applies to the use and interpretation of the information available on the platform. The Site declines all responsibility for any viruses that may infect the User’s hardware during access to the Site. The Site cannot be held liable in cases of force majeure or unforeseeable acts by third parties. The Site cannot guarantee total security and confidentiality of data but undertakes to implement all required measures to do so as effectively as possible.

Article 7: Hyperlinks

The Site may contain hyperlinks. By clicking on them, the User leaves the platform. The Site has no control over the content of external pages and cannot be held responsible for them.

Article 8: Cookies

When visiting the Site, cookies may be automatically installed on the User’s browser. Cookies are small temporary files stored on the User’s hard drive and are necessary for proper access and navigation. These files contain no personal information and cannot be used to identify a person. They enhance browsing performance on berclet.fr.

By browsing the Site, the User accepts the use of cookies. Users may disable cookies through their browser settings.

Article 9: Duration of Contract

This contract is valid for an indefinite period. The User’s first use of the services constitutes acceptance of the contract.

Article 10: Applicable Law and Jurisdiction

This contract is governed by French law. In the absence of an amicable resolution, disputes shall be submitted to the competent French courts.


Terms and Conditions of Sale

Scope of Application

The TCS of Berclet, a commercial brand of CG-Conception, apply to product sales within mainland France. Any order implies acceptance of the TCS. Modifications to the TCS require written approval from CG-Conception.

Orders

The Client may place an order in writing with signature or via electronic data exchange. CG-Conception may refuse orders submitted in other forms. An order acknowledgment is sent to the Client and takes precedence in case of discrepancy with the Client’s initial order. The Client may refuse the acknowledgment in writing within seven days, in which case the order is canceled. Otherwise, the sale is considered concluded under the conditions stated in the acknowledgment.

Delivery Times

Shipping and delivery times provided by CG-Conception are indicative. For pre-orders, products are shipped as soon as they become available.

Returns and Cancellations

  • 1 – CG-Conception Error if the products received do not match the order acknowledgment, the Client must notify CG-Conception within three business days. CG-Conception will collect the products and issue a credit note covering 100% of the invoiced price, subject to the conditions in point 4.
  • 2 – Client Error CG-Conception may authorize a return upon written request made within five business days after receipt. Products must be returned at the Client’s cost and risk within five business days of CG-Conception’s approval. A credit note of 100% of the invoiced price will be issued, under the conditions in point 4. CG-Conception may refuse returns in the event of repeated Client errors.
  • 3 – Other Return Causes CG-Conception may, on a case-by-case basis, authorize returns for other reasons, limited to standard products manufactured less than one year prior. Products must be returned at the Client’s cost and risk within eight business days after approval to qualify for a credit note, depending on the product’s condition and subject to point 4.
  • 4 – Return Conditions All returns require:
    • Prior written approval from CG-Conception’s Customer Service
    • The return authorization attached to the product
    • Products returned in new and undamaged condition
    • Products returned in their original undamaged packaging
    • Returns must not concern partial product assemblies
    • Upon request, the Client must provide the purchase invoice
  • 5 – Pre-orders The Client may cancel a pre-order before final payment and shipping. A €20 administrative fee may apply.

Pricing

Products are invoiced at the price in effect at the time the order is accepted by CG-Conception.

Payment Terms

Invoices must be paid before product shipment. For pre-orders, a €50 (VAT incl.) deposit is required. The balance is due when the product becomes available, before shipping. The deposit is invoiced separately.

Warranty and After-Sales Service

Our devices are guaranteed for normal, appropriate use. The warranty lasts 5 years and covers replacement of defective parts and repairs in our workshop.The warranty is void in cases of negligent, improper, or abnormal use.

CG-Conception also commits to offering repair or recycling services beyond the warranty period.

Use of the Brand

Any use of the Berclet brand or any related distribution brand by the Client requires prior written approval from CG-Conception, unless otherwise required by law.

Jurisdiction

The Court of TOURS (Indre-et-Loire), France, has exclusive jurisdiction over all disputes arising from this contract. Only French law applies.

Purpose

These Terms and Conditions of Sale govern the legal use of the online purchase services on berclet.fr. Any purchase made on the platform constitutes acceptance of the present TCS.
